FDA Seeks to Dismiss Suit Over Perchlorate in Food Packaging

The U.S. Food and Drug Administration on Tuesday sought to dismiss a lawsuit brought by the Natural Resources Defense Council and other environmental groups over the use of the chemical perchlorate in food packaging, saying the groups lack standing to pursue the action.

The FDA, in answering the complaint, denied the vast majority of the groups’ allegations that the agency relied on “flawed reasoning” when it rejected the NRDC’s petition to ban perchlorate, which can disrupt thyroid functions when exposed to high doses.
