ExxonMobil Faces Clean Water Act Lawsuit After Court Lifts Stay

An environmental group can proceed with a Clean Water Act lawsuit against ExxonMobil Corp. that alleges the energy giant failed to prepare a Massachusetts facility for the impact of climate change, the First Circuit ruled Thursday.

The Conservation Law Foundation, which is pursuing similar cases in Rhode Island, Connecticut, and elsewhere in Massachusetts, sued in 2016 over ExxonMobil’s terminal in Everett, Mass. It alleges that ExxonMobil’s handling of waste at the facility “may present an imminent and substantial endangerment to health or the environment” in violation of the law.
