Exxon Mobil Challenge to Superfund Settlement Opposed by DOD

The Defense Department urged the First Circuit to uphold a Superfund consent decree related to the cleanup of dioxin and other toxic chemicals at the Centredale Manor site in Rhode Island over a challenge by non-settling parties Exxon Mobil Corp., CNA Holdings LLC, and Union Oil Co. of California.

Under the consent decree, approved in April 2019, Emhart Industries Inc. and Black & Decker Inc., will perform the entire cleanup at the site, at an anticipated cost of nearly $100 million, and will pay the U.S.’s and Rhode Island’s unrecovered past and future costs. The decree also...
