EPA’s Ohio, Utah Air Rules Face Environmentalists’ Lawsuits (1)

Environmental groups are challenging the EPA’s decisions to approve changes to Ohio and Utah’s air quality plans, under two petitions filed in federal appeals courts Tuesday.

Heal Utah, the National Parks Conservation Association, Sierra Club, and Utah Physicians for a Healthy Environment are seeking the U.S. Court of Appeals for the Tenth Circuit’s review of the federal government’s November approval of an adjustment to nitrogen oxide emission controls in Utah.

The Environmental Protection Agency adopted Utah’s plan to satisfy certain regional haze requirements, including an alternative to the best available retrofit controls for nitrogen oxides at two power plants.
