EPA Update to Vehicle Rules Avoids Challenge by Amateur Racers

The EPA can avoid a lawsuit by amateur racers who said the agency overstepped its bounds by allegedly making it illegal to convert a motor vehicle into a vehicle solely intended for competitions, the D.C. Circuit ruled Friday.

The Racing Enthusiasts and Suppliers Coalition failed to show that any of its members were harmed by the agency’s move, according to the US Court of Appeals for the D.C. Circuit. The group also failed to show the Environmental Protection Agency changed its position or issued a final agency action subject to review, the court said.
