EPA Sued After Rejecting In-Person Hearing on Coal Ash Proposal

The EPA violated the law when it held a virtual hearing in lieu of an in-person one on a proposed rollback of the 2015 Coal Ash Rule, environmental groups say in a lawsuit filed in a Washington federal court.

The Environmental Protection Agency’s actions violated the Resource Conservation and Recovery Act, which mandates the agency to create meaningful opportunities for public participation, according to the lawsuit filed Monday in the U.S. District Court for the District of Columbia.
