EPA Financial Assurance Rule Written ‘in the Dark,’ Per Industry

The EPA is about to get some scathing feedback from the mining industry over proposed financial responsibility requirements for potential polluters.

Under the Comprehensive Environmental Response, Compensation, and Liability Act, also known as Superfund, the EPA requires certain classes of facilities to provide financial assurances consistent with the amount of environmental risk they incur through producing, handling, storing, moving or treating hazardous substances.

But some industry association officials say the mandates will put them out of business.
