EPA Finalizes Rule Taking Aim At ‘Stealth Regulation’ by Memos

The EPA finalized a rule restraining how it uses memos, advisories and other informal statements to shape policy that critics have said amounts to “stealth regulation.”

  • Rule, which EPA Administrator Andrew Wheeler said he signed Monday, would limit the scope of guidance documents and give the public a chance to weigh in on many of them
    • Rule also requires agency to post such documents online, create a formal process for the public to request that guidance documents be modified or withdrawn
