EPA Can’t Avoid Discrimination Lawsuit Filed by Black Employee

The Environmental Protection Agency must face a Black employee’s lawsuit alleging discrimination, retaliation, and a hostile work environment, a federal court in California said in denying the agency’s motion to dismiss for failure to state a claim.

The employee sufficiently pleaded a pattern of severe conduct to support his hostile work environment claim. He also adequately alleged a link between his protected activities and the adverse employment actions and showed a pattern of discrimination to support his retaliation claim, the U.S. District Court for the Northern District of California said Wednesday.
