EPA Beats Industry Challenges to Renewable Fuel Obligations (1)

The EPA’s requirement that fossil fuel refiners and importers shoulder the burden of making sure the fuel they pass downstream for distribution has the proper volume of renewable fuel blended in isn’t arbitrary or capricious, the D.C. Circuit said Aug. 30.

The per curiam opinion resolves several requests from oil and gas companies seeking to overturn Environmental Protection Agency policy decisions made to carry out a congressional mandate to boost renewable fuel production and the increase country’s energy independence and security.
