EPA Bar on Grant Recipients for Agency’s Boards Gets Tossed (1)

The Natural Resources Defense Council prevailed on Monday in its lawsuit challenging an EPA policy that keeps agency grantees off scientific advisory boards, with a New York federal judge finding that the directive was “arbitrary and capricious” under the Administrative Procedure Act.

The NRDC filed suit in June 2019 to challenge the directive, which said in part, “no member of an EPA federal advisory committee be currently in receipt of EPA grants.”

The directive was not only arbitrary and capricious, but it was also issued without complying with notice and comment requirements under the APA, according to the suit.
