The Environmental Protection Agency’s rule banning the production and import of products containing a flame retardant called decabromodiphenyl ether, or decaBDE, may stay in place pending the agency’s review, the Ninth Circuit ruled.
The EPA wanted to reconsider the rule after President Joe Biden directed agencies to review Trump administration actions that may conflict with its policy to improve public health and protect the environment. The agency specifically wants to decide whether further reductions to decaBDE exposure are “practicable,” it told the US Court of Appeals for the Ninth Circuit.
