EPA Ban on Advisers Who Received Agency Grants Thrown Out

The Environmental Protection Agency must resume allowing recipients of its grants to serve on agency advisory committees, a federal court in New York ruled Wednesday.

The ruling vacates an EPA decision to exclude recipients, including members of the Natural Resources Defense Council Inc., an environmental advocacy group, from serving on the committees, and sends the issue back to the agency. The instructions by Judge Denise Cote of the U.S. District Court for the Southern District of New York follow a grant of summary judgment in favor of the NRDC in February.
