Energy Department Must Again Justify Efficiency Standard Delay

The Energy Department will get a second chance to defend why it has delayed four Obama-era energy efficiency standards after a federal appeals court granted the agency’s appeal.

The U.S. Court of Appeals for the Ninth Circuit’s decision gives the department more time to work on the standards—a delay that energy-efficiency advocates strongly oppose.

The appeals court granted April 11 the Energy Department’s request to halt an order by the U.S District Court for the Northern District of California that had required the department to publish the standards by April 13.
