Emergency Wildflower Protections up to Agencies, DOJ Says (1)

Environmental groups should lose their bid to force the Bureau of Land Management and U.S. Fish and Wildlife Service to grant better protections for the Tiehm’s buckwheat wildflower despite its recent and sudden disappearance in parts of Nevada, the federal government told a federal court.

The groups’ claims should be dismissed because the Administrative Procedure Act doesn’t allow the court to interfere with matters “delegated to an agency’s discretion,” according to the motion filed Monday in the U.S. District Court for the District of Nevada.
