DuPont to Face Revived Class Suit Over Louisiana Neoprene Plant

E.I. DuPont de Nemours and the Louisiana Department of Health must face a class action over chemical releases from a neoprene plant, a split Fifth Circuit ruled after reversing a lower court’s finding that the claims were untimely.

The one-year statute-of-limitations expired before Juanea Butler first filed her complaint in Louisiana state court, according to the U.S. Court of Appeals for the Fifth Circuit. However, that time period stopped running because it’s unclear when exactly she knew her symptoms were linked to her exposure to chloroprene emissions from the plant, the appeals court said Oct. 15.
