Drexel Chemical Beats Agriculture Workers’ Pesticide Claims

Drexel Chemical Co. won’t face agricultural workers’ claims that they were poisoned by the company’s pesticides because they waited too long to file suit, the Sixth Circuit ruled Friday.

The claims, filed under the Tennessee Products Liability Act, fail because they were filed more than one year after they discovered their injuries, the US Court of Appeals for the Sixth Circuit said in an unpublished opinion.

The plaintiffs, 41 Haitian nationals employed as sugar-cane workers in the Dominican Republic, alleged they were exposed to Drexel’s pesticides on a daily basis, causing a variety of injuries.
