Does Wastewater Traveling Underground Need a Permit?

Clean Water Act regulations on the release of pollutants into waterways should be clarified by the EPA through rulemaking rather than allowing courts to sort out the ground rules, attorneys speaking at a national water law seminar said Nov. 16.

The Environmental Protection Agency needs to clarify that the National Pollutant Discharge Elimination System (NPDES) regulates wastewater pollutants discharged into surface waters—and not indirectly through groundwater—Amanda Aspatore, vice president for the National Mining Association’s water law and policy division, said at the National Clean Water Seminar in Savannah, Ga.
