Denka Performance Defeats Lawsuit Over Louisiana Neoprene Plant

Denka Performance Elastomer LLC convinced a Louisiana federal judge Wednesday to throw out as untimely a proposed class action over allegedly dangerous chemical releases from a Louisiana Neoprene plant the company bought from E.I. du Pont de Nemours.

Juanea L. Butler sued Denka and DuPont, along with Louisiana’s Department of Health and Department of Environmental Quality, alleging the ongoing release of unsafe levels of chloroprene, which has been classified as a likely human carcinogen. The case was earlier dismissed as to all parties, but was ultimately revived against Denka.
