D.C. Circuit Won’t Fast-Track EPA Climate Rule Litigation

Federal judges on Nov. 22 rejected the Trump administration’s bid to speed up litigation over the EPA’s Affordable Clean Energy Rule for greenhouse gas emissions from power plants.

The U.S. Court of Appeals for the District of Columbia Circuit said the government and its allies hadn’t given “strongly compelling” reasons for expediting the litigation, which centers on the Environmental Protection Agency’s scaled-back replacement for the Obama-era Clean Power Plan. The court also denied a request by Democratic-led states and environmental groups to put the case on ice.
