D.C. Circuit Orders FERC to Mull Pipeline Certificate Stay (1)

A panel of federal judges ordered the Federal Energy Regulatory Commission on Monday to consider whether to stay a pipeline certificate in Oregon in light of the project developer’s decision to postpone development.

The commission should consider a stay after the developer of the 230-mile Pacific Connector Gas Pipeline postponed the project, judges with the U.S. Court Of Appeals for the D.C. Circuit wrote in the order.

“The circumstances have changed substantially since the last consideration of a stay by the commission,” the judges wrote.
