Court Affirms Minnesota County Push to Aid Waste-to-Energy Goal

A federal appellate court on Friday rejected claims a Minnesota county’s ordinance intended to reduce volumes at state landfills and promote waste-to-energy initiatives discriminated against out-of-state waste haulers.

In the ruling affirming a district court decision, Judge Jonathan Kobes of the US Court of Appeals for the Eighth Circuit wrote that a 2020 Goodhue County, Minn., ordinance didn’t violate the US Constitution’s Commerce Clause by benefiting Minnesota trash-hauling businesses at the expense of Wisconsin haulers.
