Coal Ash Disposal at Former Power Plant in Ohio Draws Lawsuit

The owners of the former Beckjord power station site in Ohio are disposing of coal ash in violation of the Resource Conservation and Recovery Act’s ban on open dumping, residents tell a federal court in the state.

New Richmond Development Corp. and Commercial Liability Partners’ open dumping has contaminated groundwater and drinking water, according to the lawsuit filed in the U.S. District Court for the Southern District of Ohio. The open dumping also threatens the environment and nearby properties, Neighbors Opposing Pit Expansion told the court Tuesday.
