A challenge to the Pennsylvania Department of Environmental Protection’s approval of a natural gas compressor station belongs before the state Environmental Hearing Board and not the Third Circuit, a state appeals court ruled Tuesday.
Proceedings before the Environmental Hearing Board are administrative proceedings, not civil actions, according to the Commonwealth Court of Pennsylvania. Therefore, petitioners’ challenge doesn’t fall within the U.S. Court of Appeals for the Third Circuit’s jurisdiction, the state appeals court said.
The Quakertown Compressor Station is part of the Adelphia Gateway Project that involves buying and building natural gas transmission infrastructure between Pennsylvania and Delaware.
