Challenge to Baltimore Air Emissions Ordinance Filed

A coalition of companies and trade associations filed a challenge to Baltimore’s recently enacted ordinance that imposes restrictions on air emissions from a large waste-to-energy facility and a medical waste incinerator.

The Baltimore Clean Air Act should be struck down because the federal Clean Air Act and Maryland air and solid waste laws preempt such local mandates, according to the complaint filed in the U.S. District Court for the District of Maryland April 30.
