Biden Administration Loses Bid to Delay Coal Leasing Suit

The Biden administration failed to show hardship or inequity from having to face a lawsuit over the Trump administration’s order lifting a moratorium on coal leasing, a Montana federal court ruled.

The Justice Department sought more time for the new administration to review the Interior Secretary’s April 16 order revoking the previous administration’s decision.

The DOJ implied that the lawsuit could become moot amid ongoing policy developments, according to the U.S. District Court for the District of Montana. But this point “fails to establish hardship,” the court said Thursday.
