Bankrupt FirstEnergy Resists FERC’s Appeal of Chapter 11 Plan

Bankrupt FirstEnergy Solutions Corp. is pushing back on a federal energy regulator’s bid to appeal the Ohio utility’s reorganization plan directly to the Sixth Circuit, a legal battle that could complicate the handling of energy contracts.

Skipping over the district court won’t “materially advance the progress of the bankruptcy case,” FirstEnergy said Nov. 22 in a filing with the U.S. Bankruptcy Court for the Northern District of Ohio.
