Atlantic Richfield, Asarco Drop Supreme Court Cleanup Dispute

Atlantic Richfield Co. reversed course on its request for the U.S. Supreme Court to review its dispute with Asarco LLC over Superfund cleanup costs at a Montana site.

The companies jointly moved to voluntarily dismiss Atlantic Richfield’s petition in light of the court’s recent decision in Guam v. United States. The court held that Guam may pursue a Superfund cost recovery claim against the federal government for a $160 million landfill cleanup.
