Army Corps Can Avoid Mississippi Challenge to Flood Controls

Mississippi’s Secretary of State is unable to proceed with his challenge to the Army Corps of Engineers’ flood control measures near New Orleans, according to a Tuesday filing in a Mississippi federal court.

Michael D. Watson Jr. (R) sued the Corps over its environmental review of opening the Bonnet Carré Spillway. Once opened, the spillway sends freshwater into a lake and eventually the Mississippi Sound, which harms temperature-sensitive species, Watson argued.

The Corps has to update its environmental review for the impacts to the Mississippi Sound if “there remains a federal action to occur,” according to the U.S. District Court ...
