Amtrak Avoids Some Claims in Chicago Pollution Liability Suit

Amtrak successfully convinced an Illinois federal court to dismiss some claims by Continental Paper Grading Co. in its lawsuit seeking reimbursement for investigating contamination at a site in Chicago.

Continental Paper says spills and other releases of hazardous substances from Amtrak’s train servicing facility contaminated its neighboring facility. The lawsuit cited one spill in January 2019 where 2,800 gallons of fuel were released from a truck.

Petroleum doesn’t qualify as a hazardous substance under federal Superfund law, Amtrak told the U.S. District Court for the Northern District of Illinois. Since Continental Paper didn’t say anything other than petroleum was released ...
