States’ Bid to Rehear Carbon Costs Dispute Rejected by 8th Cir.

The Eight Circuit won’t reconsider its decision to dismiss a case brought by 13 Republican-led states challenging the Biden administration’s use of interim estimates on the harms of greenhouse gases.

Missouri, Alaska, and 11 other states challenged federal estimates for the social costs of carbon dioxide, methane, and nitrous oxide, arguing that the interagency working group that created the estimates lacked legislative authority.

A lower court ruled that the states lacked standing to sue and their claims weren’t ripe for court, and the US Court of Appeals for the Eighth Circuit agreed, finding that the states failed to allege ...
