Wisconsin Judge Pauses Six 401(k) Fee Suits for SCOTUS Ruling

Lawsuits challenging the 401(k) plan fees of Nestlé USA Inc., Costco Wholesale Corp., and four other companies will be paused until the U.S. Supreme Court rules in a similar case against Northwestern University, a Wisconsin federal judge ordered.

Judge William C. Griesbach on Thursday issued orders staying six Employee Retirement Income Security Act lawsuits pending in his courtroom in the U.S. District Court for the Eastern District of Wisconsin. The Supreme Court’s upcoming decision in Hughes v. Northwestern University is likely to affect pending motions to dismiss in each case, Griesbach said.
