Widow of Man Who Died of Autoerotic Asphyxiation Can Get Benefits

Minnesota Life Insurance Co. must pay $60,000 in accidental death benefits to the widow of a man who died of an autoerotic asphyxiation accident.

Minnesota Life shouldn’t have denied coverage because people of “reasonable intelligence” could conclude that the man’s intentionally induced asphyxiation wasn’t an intentional injury as defined by the plan, Judge Robert M. Dow of the U.S. District Court for the Northern District of Illinois held March 5. In addition, the man’s death resulted from an accidental injury that was unexpected and unforeseen, Dow concluded.
