Vail Resorts 401(k) Challenge Class is 8,200 Strong, Court Told

A lawsuit against ski resort operator Vail Corp. challenging the fees and investment options in the resort’s 401(k) plan covers a class of more than 8,200 people, a plan participant said in a motion submitted to the U.S. District Court for the District of Colorado.

Debra Kurtz wants class action status in her lawsuit accusing Vail of mismanaging its 401(k) plan in violation of the Employee Retirement Income Security Act. Her class certification motion, filed Wednesday, proposes a class of all plan participants and beneficiaries during the six-year period before she filed suit in February.
