UAW-Trane US Arbitration Over Vacation Time Revived by 8th Cir.

A lower court wrongly dismissed the United Auto Workers’ bid to reopen arbitration with Trane US Inc. over vacation pay for roughly 200 workers laid off when the company closed its Fort Smith, Ark., plant in 2017, a divided Eighth Circuit ruled Thursday.

The arbitrator’s initial award, on which the parties later sought clarification, wasn’t intended to be final, a 2-1 majority said.

That meant the 90 days International Union, United Automobile, Aerospace & Agricultural Implement Workers of America, AFL-CIO and UAW Local 716 had to seek to modify or vacate the award didn’t start to run until the arbitrator...
