Trader Joe’s Co. and three workers challenging the grocer’s 401(k) plan fees have agreed to end their proposed class action nearly a year after the case was revived on appeal.
Plaintiffs Richard Kong, Robert Cruzalegui, and Cashay Clayborn will dismiss their individual claims against the company with prejudice, and the claims of the proposed class will be dismissed without prejudice, the parties said in a stipulation filed Feb. 3 in the US District Court for the Central District of California.
