Southwest’s Attendance Rule Penalizes Medical Leave: Suit (1)

Southwest Airlines Co.'s 2019 change to its attendance discipline policy for flight attendants penalizes workers for using protected medical and family leave, a federal class lawsuit filed in San Francisco charges.

Roreste Refuerzo filed the suit Thursday on behalf of himself and similarly situated flight attendants in California and nationwide. He lost his job in February 2020 as a result of the policy change, which took effect March 1, 2019, after Southwest failed to deduct two discipline points from his record that would have been deducted prior to the change, Refuerzo says.
