Ousted Tennessee Lawmaker Loses Appeal Seeking Health Benefits

A Tennessee lawmaker who was expelled from the state legislature following an investigation into sexual harassment allegations lost his appeal seeking reinstatement of his health benefits when the Sixth Circuit ruled he lacked a vested property interest in them.

Jeremy Durham accused the state’s commissioner of finance of violating his due process rights by denying him an opportunity to continue his state-provided health coverage after his expulsion from the Tennessee House of Representatives.
