OneMain Financial Sees Age Bias Case Reinstated on Appeal

OneMain Financial Group LLC will again face litigation involving claims that its termination of a longtime employee violated federal age discrimination laws, a federal appeals court ruled.

A district court should have reviewed her contention that an agreement with OneMain calling for employee-dispute arbitration was unconscionable, the U.S. Court of Appeals for the Fifth Circuit said. Instead, the trial court ordered an arbitrator to review the issue.

The district court had the duty to assess Cathy Bowles’s argument that misrepresentation by OneMain tainted the arbitration agreement, the appeals court said.
