Officials from the state of North Carolina and three universities must face a lawsuit alleging a state health plan unlawfully discriminates against transgender employees and their dependents, a federal judge ruled on Tuesday.
Enrollees in the North Carolina state health plan sued the administrators in the U.S. District Court for the Middle District of North Carolina, alleging the plan excludes coverage for gender transformation treatment in violation of the Equal Protection Clause of the 14th Amendment, Title IX of the Education Amendments, and the Affordable Care Act.
