Jury Rejects Claim Worker Was Cheated Out of Paid Covid Leave

A Florida man failed to prove his employer illegally denied him two weeks of paid sick leave under the Emergency Paid Sick Leave Act, a federal jury ruled Thursday.

Timothy O’Bryan sued Joe Taylor Restoration Inc. June 23, 2020, under the EPSLA provisions of the Families First Coronavirus Response Act. He said he was eligible for and denied the paid time off and then fired for requesting it.

A U.S. District Court for the Southern District of Florida jury found O’Bryan didn’t establish by a preponderance of the evidence that he was entitled to Covid-related leave under the emergency law. ...
