Intel Committee Can’t Tank 401(k) Suit With Mailing, SCOTUS Told

An Intel Corp. 401(k) plan participant is pushing back on the idea that employers can cut off litigation over their retirement plans by posting plan information online, telling the U.S. Supreme Court that his challenge to the Intel plan’s investments was timely filed.

Christopher Sulyma wants the U.S. Supreme Court to affirm a decision allowing him to sue Intel’s retirement plan committee more than three years after the company sent him instructions for accessing a website with information about the plan’s investment options.
