Injured Housekeeper Who Got Workers’ Comp Has Triable FMLA Suit

A hospital contractor in Georgia may have violated federal law when it failed to tell a housekeeper who hurt her knee about her medical leave rights after she was awarded workers’ compensation benefits under state law, the Eleventh Circuit ruled Tuesday.

Hospital Housekeeping Systems LLC can’t dodge its Family and Medical Leave Act obligations to Noorjahan Ramji by pointing to its workers’ comp compliance, the federal appeals court court said. Providing an injured employee with workers’ comp doesn’t “absolve an employer of all obligations under the FMLA,” it said.
