GE Loses Bid to Have Former Judges Hear $200 Million Pension Row

General Electric Co.'s $200 million dispute with a multiemployer pension fund will be resolved through arbitration with a fund-selected arbitrator experienced in pension disputes, a federal judge in Kansas ruled.

The arbitrators proposed by the Boilermaker-Blacksmith National Pension Trust are well-suited to handle complicated disputes over pension fund withdrawal liability, Judge Eric F. Melgren of the U.S. District Court for the District of Kansas held Monday. These arbitrators are “adept at statutory construction” and have been involved in “thousands of arbitrations arising under federal law,” including arbitrations centered on the issues at play in this case, Melgren said.
