Drug Benefit Managers Take Aim at North Dakota Pricing Law

A new North Dakota law limiting how companies like Express Scripts and CVS Health profit from prescription drug sales is being challenged as preempted by federal law (Pharm. Care Mgmt. Assoc. v. Tufte, D.N.D., No. 1:17-cv-00141-DLH-CSM, complaint filed 7/11/17).

In a lawsuit filed July 11, the Pharmaceutical Care Management Association said the law—which is scheduled to become effective on Aug. 1—is blocked by the federal Employee Retirement Income Security Act and Medicare Part D, because it regulates health plans and pharmacy benefit managers that administer prescription drug benefits on behalf of plans subject to those laws.
