Doctor Suing Dozens of Health Plans Loses Again in 11th Cir.

An Atlanta-based dermatologist who’s filed more than two dozen lawsuits seeking reimbursements from health plans covering her patients racked up two more losses in the U.S. Court of Appeals for the Eleventh Circuit, which on Wednesday issued a substantial opinion “in hopes of resolving this recurring litigation.”

Wakitha Griffin’s lawsuits seeking reimbursement from health plans sponsored by Coca-Cola Refreshments USA and Delta Air Lines Inc. fail because both plans included “unambiguous and thus enforceable” anti-assignment clauses preventing plan participants from assigning to their doctors their right to sue for plan benefits, the court said.
