Case: Wage & Hour/FMLA Retaliation (E.D. Mich.)

The Salvation Army is denied summary judgment on a female former employee’s claims of retaliatory discharge for taking protected maternity leave under the Family Medical Leave Act, the Pregnancy Discrimination Act, and Michigan law, a federal district court ruled. The Salvation Army claimed it fired her because she “fraudulently” re-enrolled in its health insurance after agreeing not to do so for three years, and that there was no connection between her leave request and her termination.
