Case: Retirement Plans/Pension Benefits (S.D.N.Y.)

A PepsiCo Inc. retiree deserves a second chance to state a claim that Pepsi violated ERISA’s rule requiring that pension benefits for married couples be “actuarially equivalent” to a traditional pension, the U.S. District court for the Southern District of New York held. Pepsi retiree William DuBuske had asked the court to reconsider its September decision dismissing DuBuske’s proposed class action. DuBuske may file an amended complaint stating this claim “with the utmost clarity,” the court said. The case is Dubuske v. Pepsico, Inc., 2019 BL 430261, S.D.N.Y., No. 18 CV 11618 (VB), 11/8/19
