Case: Retirement Plans/Fiduciary Duties (E.D. Mich.)

A federal district court in Michigan adopted a U.S. magistrate judge’s recommendation granting Pilkington North America’s motion to dismiss this ERISA action by an employee alleging breach of fiduciary duties by disbursing her employer-sponsored 401(k) retirement plan entirely to her ex-husband. The court agreed with the U.S. magistrate that the claim is barred by the statute of repose and the statute of limitations.
