Case: Retirement Plans/Beneficiary & Fiduciary Duties (11th Cir.)

The Eleventh Circuit affirmed a federal district court in Georgia’s decision dismissing an action by the ex-wife of a Delta Air Lines Inc. employee for wrongful denial of benefits and breach of fiduciary duty under ERISA. After his death, the employee’s retirement benefits were disbursed to his sister as the beneficiary on file, and his ex-wife brought suit against the plan and its administrators. The Eleventh Circuit determined that the ex-wife was correctly denied benefits because she was not a beneficiary under the plan at the time of her ex-husband’s death.
